Our document review service is provided only to customers who have purchased a Binding Financial Agreement kit.
Our document review service is a referral service to a family law lawyer who will provide legal advice in relation to a binding financial agreement between yourself and your partner.
Your lawyer can provide their advice via Zoom in a face to face meeting, or over the phone and via email, although you are welcome to attend the lawyer’s office if convenient for you to do so.
Upon payment we will provide your contact details to the lawyer assigned along with a copy of your draft agreement.
At the same time, we will provide the contact details of the lawyer who will act for you. You are required to please make contact with the lawyer to set up a convenient time to discuss your agreement.
Your lawyer will explain
(i) the effect of the agreement on your rights;
(ii) the advantages and disadvantages, at the time that the advice was provided, to the party of making the agreement;
After an initial consultation, your lawyer will correspond with the lawyer acting for the other party to ensure continuity with the final document. This will be reinforced by a comprehensive Letter of Advice e-mailed to you from your lawyer. This Letter of Advice is for your eyes only and it is subject to legal professional privilege. You do not need to, nor should you, provide a copy of that letter to the other party. The other party would also have presumably received a letter of advice from their lawyer. You are not permitted to read that letter and that letter is also subject to legal professional privilege.
Upon the conclusion of your lawyer’s legal advice, they will issue a Certificate of Independent Legal Advice. This certificate is essential in ensuring the binding nature of your financial agreement. However, it’s important to note, our lawyers maintain the right to withhold the Certificate of Independent Legal Advice if they find evidence of duress, coercion, or unconscionable conduct during the interview process. This measure is in place to maintain the rule of law, fairness, and ethical conduct, and to safeguard the integrity of the legal review service.
Once each party has a Certificate of Independent Legal Advice, the parties are instructed to sign the agreement in the presence of a witness (preferably a JP), and your agreement becomes binding. After the agreement is signed, the original agreement is given to one of the spouse parties and a copy is given to the other.
